Benefit Types After a Work Injury

Benefit Types After a Work InjuryWorkplace injuries can occur in any industry, from construction and warehouse work to office settings and delivery driving. When they do, California law provides specific benefits to help employees recover physically and financially. J Smith Law, PC helps injured California workers understand their legal rights and obtain the full benefits they are entitled to under the state’s workers’ compensation system. Our small, locally respected firm provides the personalized attention larger firms can’t, offering trustworthy guidance from the very first consultation.

Medical Treatment Benefits

Medical Treatment BenefitsThe foundation of every workers’ compensation claim is access to medical care. In California, your employer’s insurance must pay for all reasonable and necessary medical treatment required to cure or relieve the effects of a work-related injury or illness.

Covered services include doctor visits, hospitalization, surgery, prescription medications, physical therapy, lab work, diagnostic imaging, and medical devices such as braces or prosthetics. According to the California Division of Workers’ Compensation (DWC), you must typically use an approved medical provider network unless you have predesignated your personal doctor before the injury. Promptly reporting your injury and following the claim process ensures you receive the care you need without unnecessary delays or out-of-pocket costs.

Temporary Disability Benefits

If your doctor determines that you cannot work while recovering, you may qualify for temporary disability (TD) benefits. TD benefits replace part of your lost wages while you heal and come in two types:

  • Temporary Total Disability (TTD): for workers who cannot perform any job duties during recovery.
  • Temporary Partial Disability (TPD): for those able to work reduced hours or in a modified position.

The standard payment equals two-thirds of your average weekly wage, subject to statewide minimums and maximums. The DWC updates its rate tables annually. Temporary benefits generally last until you return to work or reach maximum medical improvement, whichever occurs first.

Permanent Disability Benefits

When an injury leaves lasting physical or functional limitations, you may receive permanent disability (PD) benefits. After reaching maximum medical improvement, your doctor assigns a disability rating based on the extent of your impairment.

This rating translates into a specific benefit amount and payment duration. Permanent disability benefits compensate for reduced earning capacity and quality of life, even after returning to work.

Supplemental Job Displacement Voucher

If your employer cannot offer you suitable modified or alternative work after a permanent partial disability, you may qualify for a Supplemental Job Displacement Benefit (SJDB) voucher. This voucher can be used for training, education, or skill enhancement programs that help you return to the workforce.

Death Benefits

In tragic cases where a work injury or occupational illness results in death, death benefits provide financial support to surviving dependents. These benefits include reasonable burial expenses and weekly payments based on the worker’s earnings and number of dependents.

Mileage and Other Reimbursements

In addition to wage replacement and disability payments, workers may be eligible for reimbursement of transportation costs to and from medical appointments. The mileage reimbursement rate is adjusted annually. California also allows for lifetime medical treatment for work-related injuries or conditions that continue to require care, even after other benefits have been exhausted.
